Halle Berry’s ex Olivier Martinez is heading back to court again to battle with the Oscar-winning actress over custody of their three-year-old son Maceo.
According to People, the custody battle took a turn after Martinez reportedly “struck the actress in the head while they were on a beach in Bora Bora in December, following a heated argument.”
Martinez suffered a fractured skull but the duo continued filming their movie, The Girl With the Dragon Tattoo, while Halle was on medical leave.
Berry, who filed for divorce in 2014 after almost three years of marriage, filed for a temporary restraining order on April 30 against Martinez in Los Angeles.
The court documents, obtained by People, noted that Martinez had caused Halle “continuing emotional distress” and “maintained a hostile, threatening and physically threatening environment.”
Berry also alleged that Martinez “intervened in my work” by contacting her “through electronic means.”
In July, Martinez, who was listed as ‘X’ on the documents, counter-sued Berry, seeking additional support from the actress.
Berry moved to get a domestic abuse restraining order against Martinez, based on their fighting over Maceo when the couple was filming their movie in 2012.
Custody of their son now depends on which version of events, if any, is the truth.
